In the first place, the civil rights issue most certainly HAS been confirmed legally -- in the Northern District of California; the District Court of Massachusetts; the Southern District of New York; the District Court of Connecticut; and the 1st, 2nd, and 9th Circuit Court of Appeals. Second, the argument NEVER "assumes as scientific fact that gays are genetically determined to be gay" -- but it has been proven (and confirmed) that sexual orientation is not a choice. While there is no "gay gene," there is no "straight gene," either.
